Please read these Terms & Conditions carefully before registering for or participating in a Smart Student examination.

Introduction

Welcome to Smart Student – Online Academic Examination.

These Terms & Conditions ("Terms") govern your access to and use of the Smart Student website, online examinations, registration services, payment services, result services and other related services provided through the platform ("Platform").

By accessing the Platform, registering for an examination, making a payment, or participating in an examination, you acknowledge that you have read, understood and agreed to these Terms. Where the participant is a minor, these Terms shall be accepted and the registration/payment shall be completed or authorized by the participant's parent or legal guardian.

About Smart Student

Smart Student is an online academic examination platform created to provide students with an opportunity to test their academic knowledge, participate in structured online examinations and assess their performance.

Examinations may be conducted for different classes, subjects, categories, durations and formats. The specific details applicable to an examination will be displayed on the relevant examination page and/or examination announcement.

Smart Student is an academic examination platform and is not intended to operate as a lottery, betting, gambling or chance-based gaming service.

Eligibility

Eligibility for each examination may vary. The applicable examination page will specify the eligibility requirements, including where applicable:

  • Eligible classes or categories
  • Age or academic requirements
  • Subjects
  • Examination dates
  • Examination duration
  • Other participation requirements

Participants must satisfy the eligibility requirements applicable to the examination for which they register. Smart Student reserves the right to verify eligibility where reasonably required.

Where a participant is a minor, the participant's parent or legal guardian is responsible for reviewing and accepting the applicable terms and for completing or authorizing registration and payment.

Registration

Participants or their parent/legal guardian must provide accurate, complete and current information during registration. This may include:

  • Student name
  • Parent/guardian details
  • Contact information
  • Class or academic information
  • Other information required for the applicable examination

Providing false, incomplete, misleading or unauthorized information may result in cancellation of registration or examination participation. Participants and/or their parent or legal guardian are responsible for ensuring that the information submitted during registration is accurate.

Registration is subject to successful completion of the registration process and, where applicable, successful payment of the examination fee displayed on the relevant examination page.

Examination Fee and Payment

The examination fee applicable to an examination will be clearly displayed on the relevant examination page or registration process before payment. The applicable fee may vary between examinations and may be changed for future examinations.

Payments may be processed through third-party payment service providers/payment gateways. By proceeding with payment, the customer agrees to the applicable payment terms and conditions of the relevant payment service provider.

Smart Student does not store customers' card numbers, CVV, UPI PINs, banking passwords or other payment instrument credentials. Payment confirmation may be subject to successful confirmation from the payment gateway.

Customers should not make duplicate payments because of a delayed confirmation without first checking the transaction/registration status or contacting Smart Student support.

Payment Confirmation

After successful payment and registration, the participant may receive a registration confirmation through the applicable communication method.

If payment has been deducted but registration is not confirmed, the customer should contact Smart Student support with the relevant transaction details. Smart Student may verify the payment status with the payment gateway before confirming or resolving a registration.

Refund, Cancellation and Return Policy

The following refund and cancellation rules apply unless a different examination-specific policy is clearly displayed before registration.

A. Non-attendance

If a registered participant does not attend or attempt the examination, the examination fee will NOT be refunded.

B. Genuine technical issue during examination

If a participant is unable to complete the examination because of a technical issue, the participant should report the issue to Smart Student as soon as reasonably possible. Smart Student will review and verify the circumstances, examination records and other relevant information.

If the technical issue is found to be genuine, Smart Student may provide the participant with another opportunity to appear for the examination through a new examination link. If a re-examination opportunity cannot reasonably be provided, Smart Student may consider an appropriate refund after verification and according to the applicable examination policy.

A participant cannot claim a refund solely by reporting a technical issue; the circumstances must be reviewed and verified by Smart Student.

C. Payment deducted but registration/service not provided

If payment is successfully deducted but the registration is not successfully completed or the promised examination service cannot be provided because of a verified technical or payment-processing issue, Smart Student will investigate the transaction and provide an appropriate resolution, including a refund where the service cannot be provided.

D. Duplicate payment

If the same registration is successfully charged more than once, the duplicate transaction will be reviewed and, after verification, the duplicate amount will be refunded.

E. Examination cancelled by Smart Student

If Smart Student cancels an examination and does not provide an alternative examination opportunity, the applicable examination fee will be refunded.

F. Rule violation or disqualification

If participation is cancelled because of impersonation, fraudulent activity, cheating, manipulation of the examination, misuse of the platform or other violation of examination rules, no refund will normally be provided, subject to applicable law.

G. Refund processing time

Approved refunds will generally be initiated within 5–7 business days. The actual time for the refunded amount to appear in the customer's account may depend on the payment gateway, bank or payment service provider.

H. Refund method

Approved refunds will normally be processed to the original payment method used for the transaction.

I. Refund request process

Refund/support requests should be sent to support.smartstudents@gmail.com. The request should include, where applicable:

  • Participant name
  • Registered contact details
  • Examination details
  • Payment/transaction reference
  • Description of the issue

Smart Student may request additional information reasonably required to verify a refund request. Smart Student will not knowingly refuse a refund where a refund is legally required.

Examination Information

Details of each examination will be published on the relevant examination page. Such details may include:

  • Examination name
  • Eligible classes/categories
  • Subjects
  • Number of questions
  • Maximum marks
  • Examination duration
  • Examination date and time
  • Examination fee
  • Registration period
  • Examination instructions
  • Result publication information
  • Prize/award information, where applicable

The details applicable to one examination may differ from another examination. Participants should carefully review the applicable examination information before registering.

Examination Conduct

Participants are expected to participate honestly and independently. Participants must not:

  • Impersonate another person
  • Allow another person to take the examination on their behalf
  • Use unauthorized assistance
  • Share examination access credentials with another person
  • Attempt to obtain unauthorized access to examination systems
  • Manipulate examination responses or results
  • Attempt to interfere with the examination platform
  • Copy, reproduce or distribute examination questions or protected examination material without permission
  • Use automated systems, scripts or other methods intended to unfairly manipulate the examination
  • Engage in fraudulent or unlawful activity

Smart Student may review suspected violations and may cancel or withhold an examination result where there is reasonable evidence of a violation of the applicable examination rules.

Examination Access and Technical Requirements

Participants are responsible for using a compatible device and maintaining a reasonably stable internet connection during an online examination. Participants should review any technical requirements or instructions provided before beginning the examination.

Smart Student is not responsible for problems caused solely by:

  • Participant's device
  • Participant's internet connection
  • Local network issues
  • Power failure
  • Browser problems
  • Unsupported devices or software
  • Third-party service interruptions outside Smart Student's reasonable control

However, if a participant experiences a significant technical issue affecting examination participation, they should contact Smart Student as soon as reasonably possible. Smart Student may review genuine technical issues and determine an appropriate resolution according to the circumstances and applicable examination policy.

Examination Submission

Participants must complete and submit their examination within the applicable examination duration. Where the examination system automatically submits an examination at the end of the permitted duration, the participant agrees to such automatic submission.

Once an examination has been finally submitted, changes to answers may not be possible. The applicable examination instructions displayed before or during the examination shall govern the submission process.

Results and Ranking

Results will be calculated according to the evaluation method applicable to the particular examination. Where applicable, ranking may be determined based on factors such as:

  1. Score obtained
  2. Completion time or another tie-breaking criterion announced for that examination

The specific ranking and tie-breaking rules applicable to an examination will be communicated through the relevant examination information. Smart Student may verify participant information and examination records before finalizing results or rankings.

Prizes and Awards

Where an examination includes prizes, awards or other forms of recognition, the applicable details will be displayed on the relevant examination page or examination announcement. The applicable information may include:

  • Rank-wise prize/award amounts
  • Eligibility conditions
  • Tie-breaking rules
  • Verification requirements
  • Prize distribution process
  • Documentation requirements, where applicable

Prize or award information may differ between examinations. Awards are subject to the eligibility, examination rules and conditions announced for the relevant examination.

Smart Student may verify the identity and eligibility of a participant before releasing an award. A participant may become ineligible for an award if the participant is found to have violated examination rules, provided false information, impersonated another person or otherwise participated fraudulently.

Where a participant is a minor, prize-related communication and payment/disbursement may require involvement or verification of the parent or legal guardian, as applicable.

Participation Acknowledgement / Certificate

Where participation acknowledgement or certificates are offered for an examination, the applicable information will be communicated as part of the examination details. The format, eligibility and method of delivery may vary between examinations.

Participants must provide accurate information to enable correct preparation of any applicable acknowledgement or certificate.

Accuracy of Information

Participants and parents/legal guardians are responsible for ensuring that all information provided to Smart Student is accurate and current. Smart Student may rely on the information submitted during registration for:

  • Examination registration
  • Communication
  • Results
  • Rankings
  • Certificates
  • Prize/award verification
  • Customer support

Smart Student is not responsible for errors resulting from incorrect information submitted by the participant or parent/legal guardian.

Intellectual Property

The Smart Student name, logo, branding, website design, examination content, questions, text, graphics, software, layouts and other original materials available through the Platform may be protected by applicable intellectual property laws.

Except where expressly permitted, users must not do any of the following without appropriate authorization:

  • Copy
  • Reproduce
  • Modify
  • Republish
  • Distribute
  • Sell
  • Commercially exploit
  • Reverse engineer
  • Create derivative works from Smart Student's protected content or materials without appropriate authorization

Examination questions and examination materials are confidential to the extent permitted by applicable law and the applicable examination rules.

Acceptable Use

Users must use the Platform only for lawful and legitimate purposes. Users must not attempt to:

  • Gain unauthorized access to the Platform
  • Access another user's account or information
  • Circumvent security controls
  • Introduce malicious software
  • Interfere with website operation
  • Overload or disrupt the Platform
  • Scrape or systematically copy protected examination content
  • Attempt to manipulate examination results
  • Use the Platform for fraudulent purposes
  • Use the Platform in violation of applicable laws

Smart Student may take appropriate action where misuse or unauthorized activity is identified.

Website Availability

Smart Student aims to provide reliable access to the Platform and examination services. However, uninterrupted availability cannot be guaranteed at all times due to circumstances including:

  • Scheduled maintenance
  • Technical failures
  • Internet or network problems
  • Third-party service interruptions
  • Payment gateway issues
  • Hosting or infrastructure issues
  • Security incidents
  • Events beyond reasonable control

Where reasonably possible, Smart Student may provide information regarding significant planned interruptions.

Changes to Examination Details

Smart Student may, where reasonably necessary, update or modify examination details such as:

  • Examination date
  • Examination timing
  • Eligibility
  • Examination format
  • Subjects
  • Duration
  • Fee
  • Registration period
  • Prize/award structure
  • Technical instructions

Where material changes are made, Smart Student will communicate them through appropriate website or examination communications where reasonably practicable. The examination-specific information applicable at the time of participation shall be considered together with these Terms.

Cancellation or Suspension of Participation

Smart Student may cancel or suspend a participant's registration or participation where reasonably necessary, including in circumstances involving:

  • False or misleading information
  • Ineligibility
  • Impersonation
  • Fraudulent activity
  • Violation of examination rules
  • Unauthorized access
  • Attempts to manipulate the examination
  • Security concerns
  • Violation of applicable laws

Where registration or participation is cancelled due to a participant's violation of these Terms or examination rules, the participant may not be entitled to a refund except where required by applicable law or specifically provided under the applicable examination policy.

Privacy and Personal Information

Smart Student may collect information necessary to provide examination registration, payment confirmation, communication, examination participation, results, support and related services. Personal information will be handled in accordance with the applicable Privacy Policy and applicable laws.

Users should review the Smart Student Privacy Policy for information about how personal information is collected, used, stored and handled.

Smart Student will not request customers to share payment instrument credentials such as card PINs, CVV, UPI PINs or banking passwords through email, telephone, chat or other support channels.

Third-Party Services

The Platform may use third-party service providers for services such as:

  • Payment processing
  • Hosting
  • Email or communication
  • Analytics
  • Security
  • Other technical services

Use of such services may be subject to the terms and policies of the relevant third-party providers. Smart Student is not responsible for the independent policies or availability of third-party services, except to the extent required under applicable law.

Payment Security

Payments made through Smart Student may be processed by an authorized third-party payment gateway. Users should complete payments only through the official payment interface provided through the Smart Student Platform.

Smart Student will not ask users to provide the following through support channels or for manual verification:

  • UPI PIN
  • ATM PIN
  • Card PIN
  • CVV through support channels
  • Internet banking password
  • OTP for manual verification

Users should never share such confidential payment credentials with any person claiming to represent Smart Student.

Customer Support and Complaints

For questions, payment issues, registration problems, examination issues or other concerns, users may contact Smart Student using the official contact details published on the website.

Smart Student will make reasonable efforts to review and respond to customer concerns. Users should provide relevant information, such as registration details or transaction reference information, where necessary to help investigate an issue.

Limitation of Liability

To the extent permitted by applicable law, Smart Student shall not be responsible for indirect, incidental or consequential losses arising solely from circumstances beyond its reasonable control.

Nothing in these Terms is intended to exclude or limit any liability that cannot lawfully be excluded or limited under applicable law. Nothing in these Terms affects any statutory rights available to consumers under applicable law.

Indemnity

To the extent permitted by applicable law, a user may be responsible for losses or claims arising from the user's:

  • Fraudulent activity
  • Misuse of the Platform
  • Violation of these Terms
  • Violation of examination rules
  • Unauthorized use of another person's information
  • Violation of applicable law

This clause does not limit any rights or remedies available to users under applicable law.

Changes to These Terms

Smart Student may update these Terms from time to time to reflect changes in:

  • Services
  • Examination processes
  • Payment processes
  • Applicable laws
  • Platform functionality
  • Business practices

The updated Terms will be published on the website with the applicable "Last Updated" date. Users should review the Terms periodically.

Continued use of the Platform after updated Terms are published may constitute acceptance of the updated Terms to the extent permitted by applicable law.

Governing Law

These Terms shall be governed by and interpreted in accordance with the laws applicable in India. Any dispute shall be subject to the jurisdiction of the courts having appropriate jurisdiction over the relevant matter and location, subject to applicable law.

Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable by a competent authority, that provision shall be interpreted or modified to the extent necessary to make it enforceable, and the remaining provisions shall continue to apply to the extent permitted by law.

Entire Agreement

These Terms, together with the applicable examination information, examination-specific rules, refund/cancellation policy, Privacy Policy and other policies expressly referenced on the Platform, constitute the terms governing the user's use of the relevant Smart Student services.

Where examination-specific terms are expressly provided for a particular examination, those terms shall apply to that examination in addition to these general Terms.
